Policies, enforcement, and how to report content on GhostBin.

Overview

GhostBin is an internet service that provides its users with the ability to publish information without the fear of censorship. We do not remove content unless it violates an established policy.

This page sets forth the superseding Terms of Service for GhostBin and includes general information. By accessing or using GhostBin, you agree to the terms outlined on this page. If you do not agree, do not use this website. Your use of this service is completely voluntary.

Law Enforcement Policy

Law enforcement officers with authority may contact us by email alc4zy@gmail.com. If you are a law enforcement officer and are contacting us with the intention of having content removed, we can voluntarily remove content upon request in accordance with our Terms of Service and applicable law.

Please note that requests for user information will not be honoured voluntarily. You may, however, request that we remove specific user content.

We ask law enforcement officers to provide the following in requests:

  • The name of your law enforcement authority, including the country, state, province.
  • Proof of authority, which may include your badge, agency contact information, or other documentation showing that you are authorised to submit the request.
  • An email address with a government domain.
  • A written request in English.
  • Identifier of the relevant GhostBin user and/or post. Possible identifiers include Username, User ID, Title, URL, or other information which may help us locate a specific user or post.
  • Indication whether such request can lawfully be disclosed to the relevant user.
  • Indication whether such content may expose GhostBin’s administrators to criminal liability under the laws of your jurisdiction if no action is taken.

Unless otherwise indicated in the request, we may notify the relevant user that their content was removed in response to a law enforcement request.

For urgent requests, include URGENT REQUEST in the subject line.

Unlawful Content and Liability Policy

Users are solely responsible for determining whether accessing, viewing, posting, or interacting with GhostBin is lawful in their jurisdiction. Sharing personal information (i.e. doxing) is not a crime in our jurisdiction, however, certain conduct such as stalking, inciting fear of serious bodily injury, or the sexual exploitation of minors absolutely is, and we recognise that.

As such, content that violates governing law (i.e. any violation of our jurisdiction’s code), whether such violation is a criminal or civil offence, is strictly prohibited on GhostBin and will be removed once we become aware of its existence. Additionally, we may voluntarily remove content that is deemed illegal under applicable law to avoid any criminal liability on our part. Unlawful Content may include, but is not limited to, the publication of threats to kill, harm, or kidnap a person, or the publication of content to assist in the criminal extortion of an individual, or the publication of a visual depiction that involves the use of a minor engaging in sexually explicit conduct. We do not turn a blind eye to Unlawful Content for any reason, nor will we ever encourage users to engage in unlawful activities. Therefore, users are solely responsible for whatever they do. To the maximum extent permitted by law, GhostBin, its owners, administrators, staff, and other agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to use of the service.

Illegally obtained content is also removed by us in a good faith effort when there is a preponderance of the evidence that the author themselves illegally obtained such content. We take action against illegally obtained content to discourage users from maliciously obtaining private information for immediate publication on our platform. Though we require sufficient evidence of such conduct or a valid court order to take action.

Does GhostBin promote harassment, swatting, violence, etc? Absolutely not. We have never encouraged our users to engage in illegal activities and are strongly against such conduct. Users that directly use our platform for any patently illegal purpose will be banned. We specifically do not want users to write messages that may encourage harm or unwanted harassment to a person. The advocacy of illegal action is a category of speech that is not protected by law. For example, writing messages such as ‘swat this person...’, or ‘text this number...’, or ‘go to this paedophile’s house...’ is strictly prohibited and you will be banned for saying such things on our platform. We employ many sufficient non-invasive methods to moderate GhostBin and restrict illegal content, that we are in no way responsible for what some completely unrelated, mentally disturbed individual may do. We do not swat, harass, or intimidate anyone, nor do we directly or indirectly encourage anyone else to.

Here is a hypothetical example: Alice is a user of YouTube and publishes a story on Bob, who is a paedophile. Completely unrelated to Alice, an anonymous viewer watches her story and decides they are going to swat Bob. Alice in no way encouraged anyone to swat, harm, or take any related action against Bob. So is YouTube, not the viewer who swatted Bob, but YouTube themselves, suddenly involved in the swatting and harassment against Bob? Clearly not, but people try to bring these claims against GhostBin and attempt to drag us into situations in which we have zero involvement.

Defamation Policy

Authors of defamatory posts are responsible for the defamatory content pursuant to governing law. We do not need to remove defamatory content without a court order, but we make a good faith effort to remove defamatory content when provided with sufficient evidence showing that such content is patently defamatory. GhostBin is not a place to defame innocent people, and you may be banned if you are caught wilfully doing so. To avoid a violation of this policy, content containing damaging claims about a person or company should be supported by adequate evidence. We find that wrongful accusations carry substantial risk, so do not upload defamatory content.

The truth is not defamation (e.g., if someone really is a paedophile). We recognise that protecting factual and truthful speech is essential to free speech. As a result, we do not penalise people for making truthful statements, even if those statements are embarrassing to another. The burden of proving the truth generally falls on the author of the content.

Discretionary Policy

Our Staff Team may use their discretion to remove content. We make a good faith effort to avoid censorship, but reserve all rights to remove content we find substantially unethical or not serving any meaningful purpose. This may include, but is not limited to, spam, malware, personal information of a person who has not attained the age of 15 years, or targeted harassment which would be reasonably expected to cause substantial emotional distress to a person.

Removing Content

Child Sexual Abuse Material (Child Pornography)

GhostBin has always prohibited Child Sexual Abuse Material. We do an outstanding job of not only removing CSAM, but also preventing it on our platform in the first place by scanning most publicly available user content such as public posts and profile images. This is a completely non-invasive tactic we use to mitigate abuse as such user content is intended to be public anyway. We consider CSAM to include any visual depiction of a minor engaging in sexually explicit conduct. GhostBin does not host user files apart from profile images, which are effectively scanned for abuse before becoming accessible on our domain. We absolutely do not allow users to include links in posts directing to CSAM, and doing so is not a loophole to avoid removal.

If you are a victim, know a victim, or would like to report Child Sexual Abuse Material to us, please contact us immediately by email alc4zy@gmail.com and include CSAM in the subject line. Do not directly attach Child Sexual Abuse Material to the email. Simply send us the relevant GhostBin post URL(s). We do not require victims to verify their age to remove content that contains CSAM. We strongly encourage victims or anyone with knowledge of CSAM on our platform to immediately contact us so we can remove it as quickly as possible.

We will take action against CSAM and users posting CSAM within 12 hours once reported to us. We aim to prioritise these types of reports and often provide a resolution within a few hours.

Non-Consensual Sexually Explicit Imagery

In addition to Child Sexual Abuse Material, GhostBin also prohibits non-consensual intimate visual depictions of adults.

Unlawful Content

Pursuant to our Unlawful Content and Liability Policy, Unlawful Content may include, but is not limited to—

  1. content or links to content encouraging harassment, unwanted contact, or emergency responder hoaxes;
  2. content lawfully ordered to be removed by a competent jurisdiction;
  3. content or links to content depicting child abuse (i.e., Child Sexual Abuse Material, Child Pornography, Child Self-Harm Material);
  4. content or links to content that infringes a registered trade mark holder’s rights; or
  5. content or links to content that includes the non-consensual publication of intimate visual depictions.

Please report Unlawful Content by email alc4zy@gmail.com. If not otherwise clearly apparent, please include identification of and copies of the text of a statute, law, or regulation recognised by a competent jurisdiction or the International Berne Convention that demonstrates the content to be unlawful.

Harmful Content

GhostBin prohibits content deemed to be harmful, which may include, but is not limited to—

  1. content or links to content encouraging harm;
  2. content or links to content depicting gore, self-harm, or other disturbing material;
  3. content or links to content that are sexually suggestive (pornography, nude, lewd, or obscene material).

GhostBin is not a porn or gore website and does not support such use cases.

Civil Claims

If your rights have been violated, you should seek relief in a competent jurisdiction by bringing a lawsuit against the author(s) of the relevant content. A court order to remove content will be honoured in full.

In the United States, the Communications Decency Act immunises websites from liability for a majority of user-generated content. Therefore, an affected party must go after the author(s) themselves. Court orders must be against the specific author(s) of the content and not GhostBin.
